Art. 1 – Acceptance of the general conditions of sale and conclusion of the contract signed between Bairon Srl. and the Customer (ie the subject, a natural person who makes the purchase on the Site, and not related a business, commercial or professional entity) shall be deemed to have concluded with the acceptance, even partial, of the order by Bairon Srl In the case of non-acceptance of the order, Bairon Srl will provide timely communication to the Customer.
By placing an order in one of the various ways provided, according to the order form on the Site (hereafter the “Order”), the Customer declares that he has viewed all the information provided to him during the purchase procedure and accepts in full these General Terms and Conditions (hereinafter the “Terms”).

Art. 2 – Purchase
The products offered for sale by Bairon Srl are only those on Bairon Srl’s website at the time of the order, as described in the relevant information sheets.
In any case, it is understood that the images accompanying the descriptions of a product are for informational purposes only and may not be perfectly representative of its characteristics but differ, for example, in color and size (also based on the browser and monitor used for accessing the Site and viewing images).
The Customer must complete in its entirety the relevant order form on the Site and submit it after having carefully reviewed the Terms, as well as the characteristics of the product and / or the products he intends to purchase. If the Customer requires a tax invoice relating to the purchase, it should be requested of Bairon Srl, at this time, pursuant to art. 22 D.p.R. n. 633/1972.
Bairon Srl will confirm the correct receipt of the Order via an e-mail response sent by orders@maribemer.com to the e-mail address indicated by the Customer. This confirmation message will summarize the terms of purchase under applicable law, as well as the data entered in the Order by the Customer, so that they can verify the same and, if necessary, communicate the necessary corrections of incorrect data without delay.

Art. 3 – Prices and Payment Methods
The prices indicated on the site are to be considered VAT included. Any costs of shipment or payment will be communicated to the Customer in advance through the Site or in these Terms. The following payment methods are available:
• PayPal
Payment may be made by the customer according to the specific terms of the Paypal circuit.
Credit Card
Purchase of goods with payment method Credit Card, entails a transaction through a secure Paypal server or other secure server selected by Bairon Srl. Under no circumstances and nor at any stage of the payment will Bairon Srl be in able to know Customer’s credit card information, which is transmitted through a secure connection directly to the bank’s website managing the transaction. No Bairon Srl computer archives will keep this data and therefore in no case will Bairon Srl be held liable for any fraudulent and unlawful use of credit cards by third parties at the time of payment.
• Bank Transfer
In the event of a purchase by bank transfer, the bank details will be communicated for the payment. The payment by bank transfer entails an additional cost of Euro 8,00 to be paid by the Customer. The shipment of the merchandise will only be effected upon the actual receipt of the bank payment.
The seller reserves the right to request additional documentation from the customer proving the credit card holder’s identity. In the absence of this confirming documentation, the vendor reserves the right not to accept the order. Transaction security is guaranteed by a data encryption system (SSL) and by direct, secure and certified links.

Art. 4 – Delivery of Products and Expenses
The delivery times of Mario Bemer Firenze products are 1-2 days for Italy, 3-4 business days for the rest of the world, 24 hours after the order is accepted, if the goods are immediately available. Shipping address will be that indicated by the Customer on the Order form, at the cost specifically indicated on the Site prior to the order confirmation.
If not immediately available, the products will take 4/5 weeks for production and delivery.
Bairon Srl reserves the right to accept or refuse deliveries made outside the Italian or European borders For shipment to countries outside the European Union, any import customs charges will be borne by the recipient. The customer is therefore asked to contact the country’s customs authorities in advance to check the costs and possible import limits. The delivery times indicated by Bairon Srl are to be regarded as purely indicative and delays with respect to the same, or for example, delivery carried out with partial shipments, does not entitle the Customer to refuse the delivery and to claim damages or compensation.
When accepting the delivery of the order, the Customer is required to check:
• the number of packages delivered corresponds to the number stated in the shipping document.
• the packaging is intact, not damaged, neither wet nor otherwise altered, including the closing materials (adhesive tape or metal strips) .
Damages to the packaging and / or product damage or non-conformance to the number of packages must be immediately identified, and specifically indicated on the shipping document of the product to be returned to the courier. Any problems with the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery, according to the methods provided in this document.

Art. 5 – Right of withdrawal/return policy
According to art. 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the Customer may terminate the Terms and Conditions and therefore the Purchase Agreement for any reason without the need to state the reasons and without any penalty within 14 (fourteen) working days from the date of receipt of the products.
In order to exercise the right of withdrawal referred to in Article 5.1 above, the Customer shall send Bairon Srl a notice to this effect within the terms indicated at the following email address customercare@mariobemer.com, or use the form provided on the Site.
In case of withdrawal/return, the Customer will have to return the products at their expense within 14 (fourteen) days from the date of its withdrawal, to Bairon Srl at the following address:

The merchandise must be returned intact, complete with all its parts and original packaging (envelopes and packages), and, where appropriate, used only for the time strictly necessary to establish and verify its nature, characteristics and size, according to normal diligence, without signs of wear or dirt, subject to the following conditions:
• the right of withdrawal (return) applies to the product purchased in its entirety; it is not possible to return only part of the purchased product (eg accessories, etc …);
• In order to return the goods, the product must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation accessories: labels, tags, seals, etc …);
• shipping costs (and customs charges, if any) for returning the goods will be the sole responsibility of the Customer;
• the shipment, up to its registered arrival in the warehouse indicated by Bairon Srl, is under the full responsibility of the customer;
• In the event of damage to the goods during transport, Bairon Srl will notify the Customer so that they can promptly file a complaint with their selected courier and obtain the corresponding refund; the product will then be made available to the Customer, simultaneously canceling the request for return;
• Bairon Srl will not respond in any way to damage, theft, loss occurring during or in any case depending on the shipment for return.
Bairon Srl will refund to the Customer the full amount already paid, within 14 (fourteen) days after the return, by a cancellation of the amount charged, using the same means of payment used by the Customer for the initial transaction, unless otherwise agreed. In any case, the Customer will not bear any costs as a result of such reimbursement. Bairon Srl may suspend the refund until receipt of the returned product or until the Customer provides documentation that the Product has been correctly returned.
In any case, the Customer will lose the right of withdrawal in cases where Bairon Srl establishes that:
• the returned product and / or its accessories, and / or its packaging are not complete;
• the product is missing its outer packaging and / or the original interior packaging;
• the product lacks integrating elements and / or accessories (eg closures, laces, buckles, etc.).
In the event of the cancellation of the right of withdrawal/return, Bairon Srl will return the product to the sender, charging the shipping costs and, if already refunded, the price of the product.

Art. 6 – Guarantees
All products sold by Bairon Srl are covered by the 24 (twenty-four) month warranty for defects of conformity, pursuant to Title III of D.Lg. 206/2005. In order to benefit from warranty service, Customer must keep the invoice, ie the payment receipt, together with the shipping document.
The Warranty for Compliance Failures will apply as long as the relevant product has been used correctly, in accordance with its intended use and with the instructions for use and care accompanying the product.
In the event that, for any reason, Bairon Srl is unable to return the product under warranty (repaired or replaced), to the Customer or where the repair or replacement was too costly due to the value of the product, Bairon Srl will refund of the whole amount paid for the product.
In cases where the warranty application provides for the return of the product, the customer must return it in its original packaging, complete in all its parts (including packaging and any documentation and accessories). Bairon Srl will in this case pay for shipping.

Art. 9 – Applicable law
The sales contract referred to in these Terms and Conditions and its execution is governed by Italian Law and the Rules of the United Nations for International Sale of Goods.. Any disputes will be resolved in the Court of Firenze.

Art. 10 – Copyright
Trademarks, logos and other symbols on the site belong to their respective owners. The use of trademarks, logos and other distinguishing marks including reproduction on other websites by unauthorized third parties is not permitted. Art. 11 – Agreement

You must follow the on-line procedure carefully to make the purchase. Bairon Srl reserves the right to refuse or cancel an order, in case of doubts about the truthfulness – incomplete or inconsistent personal data, payment defaults already made in previous purchases, doubtful authenticity of the credit card – or unavailability of the products. The refusal or cancelation of the order (via e-mail or phone) may not be immediate and may also occur after contacting the customer.
How do I make my purchase?
Purchasing on this site is simple:

Shipment

Shipment by courier: DHL
A parcel tracking service is active for this forwarder.
The courier handles deliveries from Monday to Friday, both in the morning and in the afternoon. The recipient cannot request delivery on specified days or times. In case of the absence of the recipient, the courier will leave a notice of the attempt to deliver, via a card left at the address. Delivery will be attempted three times; then the courier will try to contact the recipient. Bairon Srl will not be liable for any malfunctions in the delivery service by the courier.
In case of deliveries made at a reception desk (with signature for the delivery by the receptionist), Bairon Srl will not be held liable for subsequent non-delivery of the parcel to the final recipient. If a country of destination does not appear among those listed, it means that there is currently no delivery of the products in that country. However, since Bairon Srl is considering the opportunity to extend the list of countries to which shipments are made, we recommend contacting customercare@mariobemer.com.
When receiving the delivery of the order, the Customer is required to check:

Shipping Times

If the product is not immediately available, the production and delivery times will be up to 4/5 weeks. Delivery delays may be caused by the temporary unavailability of the products, malfunctioning of the courier service, for reasons of force majeure or holidays. Customs and taxes
Regarding the deliveries to countries outside the European Union, any import customs duties will be charged to the recipient. Customs duties and taxes vary depending on the country of destination and are applied upon arrival of the goods in the same country. Therefore, you are requested to contact the customs authorities of your country in advance to check the costs and possible import limits.
In the case that the customer refuses the goods or the failure to deliver for other reasons (eg wrong address and / or telephone number of the recipient, repeated absence of the recipient, etc.) an amount will be deducted to cover the following expenses: cost of shipping the merchandise + return shipment of the goods + customs for reentry and charged to the recipient.
